Welcome to Wildflower Bakes. These Terms & Conditions apply to orders for cakes, cupcakes, traybakes, cake pops, treat boxes and other products supplied by Wildflower Bakes.
Please read these Terms & Conditions carefully before placing an order. By accepting a quote, paying a deposit or otherwise confirming an order, you agree to be bound by these Terms & Conditions.
These Terms & Conditions, together with the agreed order details and any applicable invoice or written order confirmation, form the agreement between Wildflower Bakes and the customer.
1. The Parties
These Terms & Conditions form an agreement between:

and the customer named in the relevant order details, invoice or booking confirmation.
In these Terms & Conditions, “Wildflower Bakes”, “we”, “us” and “our” refer to Wildflower Bakes. “The customer”, “you” and “your” refer to the person placing the order.
2. Order Details and Description of Services
The specific products and services being provided will be confirmed to the customer in writing before the order is accepted.
Depending on the type of order, the order details may include:
the product or products ordered;
size, quantity or number of servings;
flavour(s);
filling(s) and icing;
agreed design, theme and colour scheme;
wording or personalisation;
decorations and toppers;
any non-edible elements;
collection date and collection time;
total price;
deposit paid;
remaining balance; and
any other relevant requirements agreed between Wildflower Bakes and the customer.
The agreed order details may be provided by email, message, invoice, booking confirmation or another written form of communication.
The customer is responsible for checking the agreed order details and informing Wildflower Bakes as soon as possible if anything is incorrect.
3. Quotes and Acceptance of Orders
Quotes are valid for 14 days from the date they are issued unless otherwise stated.
A quote does not reserve a collection date or booking slot. A date is only secured once the required deposit or other agreed payment has been received.
Wildflower Bakes reserves the right to decline an order before it has been accepted.
Once the required deposit has been paid and the order has been accepted, the booking is considered confirmed, subject to these Terms & Conditions.
4. Booking and Deposits
A deposit is required to secure a booking unless otherwise agreed in writing.
The deposit is intended to reserve the agreed date and collection slot and to contribute towards work and costs associated with accepting the booking, including administration, design preparation, planning and materials.
A deposit is not automatically refundable in every circumstance. The amount retained or refunded will depend on the circumstances of the cancellation or postponement and the reasonable costs and losses incurred by Wildflower Bakes.
Where Wildflower Bakes is unable to fulfil an order for reasons within its responsibility, any refund due will be dealt with in accordance with Section 8 of these Terms & Conditions.
No date will be held or reserved until the required deposit has been received.
5. Payment
The total price of the order will be confirmed to the customer before the order is accepted.
The remaining balance must be paid in full by the deadline stated in the order confirmation or invoice and, unless otherwise agreed, before or upon collection.
Wildflower Bakes reserves the right not to release an order until the full balance has been paid.
If the customer fails to pay the remaining balance by the agreed deadline, Wildflower Bakes may contact the customer to request payment and may cancel the order where payment remains outstanding.
Any cancellation or costs arising from non-payment will be considered in accordance with these Terms & Conditions.
Additional charges may apply where the customer requests changes to an order that affect the agreed price.
6. Design Changes and Alterations
Minor Changes
Reasonable minor changes to colours, flavours or small design details may usually be accommodated where sufficient notice is provided.
Requests should ideally be made no later than two weeks before the collection date.
Major Changes
Changes to the size, quantity, structure, flavour, fillings, major design elements or other significant aspects of an order may not be possible once preparation has begun.
Changes may require a revised quote.
Any additional costs resulting from an agreed change must be paid before the revised work is completed.
Artistic Interpretation
Reference images, sketches, inspiration photographs and AI-generated concepts may be used as guidance.
All cakes and other products are handmade and individually created. Minor variations in colour, size, shape, texture and decoration may occur.
Wildflower Bakes does not promise to create an exact replica of another artist’s work or of a digitally generated design.
Wildflower Bakes may use its professional judgement when adapting a design to ensure that the finished product is structurally sound, practical to create and suitable for use as food.
7. Customer-Supplied Items and Designs
Where the customer supplies decorations, toppers, artwork, images or other materials for use with an order, the customer confirms that they have the right to provide those materials for use.
Wildflower Bakes is not responsible for the quality, suitability, accuracy or legal ownership of customer-supplied materials.
Customer-supplied items may be subject to additional charges or may be refused where they are unsuitable, unsafe or incompatible with the product.
8. Illness, Postponements and Cancellations
We understand that plans change. Children get poorly, emergencies happen and unexpected family situations can arise. If you need to change your date, please contact Wildflower Bakes as soon as possible.
Postponing an Order
Where reasonably possible, Wildflower Bakes will try to transfer the booking and any eligible deposit to a new collection date within six months of the original collection date.
The new date will be subject to availability.
A postponement may not be possible where production has already substantially begun or where ingredients, materials or bespoke items have already been purchased or prepared.
Postponements Within 48 Hours
If you need to postpone an order within 48 hours of collection, please contact Wildflower Bakes as soon as possible so that production can be paused where possible.
Where the cake or other products have already been baked, prepared or decorated, Wildflower Bakes will discuss the available options with the customer.
These may include rescheduling the order, adapting the order or proceeding with the order where appropriate.
Customer Cancellations
If the customer cancels an order without rescheduling:
cancellations made more than four days before collection will normally result in the deposit being retained, with no further balance due, subject to the circumstances of the cancellation and any applicable consumer rights;
cancellations made within four days of collection may result in Wildflower Bakes retaining reasonable costs and losses already incurred in preparing for the order, including ingredients, materials, bespoke items and work already completed.
Any amount retained will be considered in proportion to the reasonable costs and losses incurred.
Cancellation by Wildflower Bakes
Wildflower Bakes may cancel an order where it is unable to safely or reasonably fulfil the order, including because of serious illness, an emergency, equipment failure or other circumstances beyond its reasonable control.
The customer will be notified as soon as reasonably possible.
Where Wildflower Bakes cancels an order and the customer has paid money for products that will not be supplied, any refund due will be processed as soon as reasonably practicable.
Where Wildflower Bakes is unable to fulfil an order because of circumstances beyond its reasonable control, its liability will not exceed the amount paid by the customer for the affected order, except where liability cannot legally be limited.
9. Collection
Collection is from the Wildflower Bakes collection location in Wetherby and is by agreed appointment or collection slot.
Customers should arrive within their agreed collection window.
If the customer is going to be late, they should contact Wildflower Bakes as soon as possible.
Where a customer misses a collection appointment without prior notice, Wildflower Bakes will make reasonable efforts to arrange another collection time.
A missed collection may result in additional arrangements being required and products may not be available indefinitely due to their perishable nature.
10. Transport and Responsibility After Collection
Once an order has been collected by the customer, the customer is responsible for transporting and handling it safely.
Cakes should be transported:
on a flat and stable surface;
in a cool vehicle where possible;
away from direct sunlight and excessive heat;
away from loose items that could fall onto or damage the cake; and
in accordance with any specific instructions provided by Wildflower Bakes.
Cakes should not be transported on a vehicle seat or on a passenger’s lap.
Wildflower Bakes cannot be responsible for damage caused after collection where that damage results from incorrect transport, handling, storage or use.
11. Storage and Consumption
Products are baked fresh to order.
Specific storage instructions may be provided with the order and should be followed.
Unless otherwise instructed, cakes should generally be kept in their original box in a cool, dry place away from direct sunlight and heat.
Customers should follow any specific storage instructions provided for products containing ingredients or decorations requiring particular care.
Products are best consumed within the timeframe stated on the product information or care instructions provided.
Once a cake has been cut, leftovers should be stored appropriately in an airtight container or wrapped securely.
Wildflower Bakes cannot accept responsibility for deterioration caused by incorrect storage or handling after collection.
12. Non-Edible Elements and Safety
Some products may contain non-edible elements, including structural supports, dowels, toppers, card, acrylic, silk flowers or other decorative items.
Non-edible elements will be identified where appropriate on the product packaging, safety information or care instructions.
Customers are responsible for ensuring that non-edible elements are removed before the product is cut and served.
Customers should inform guests, particularly children, where a product contains non-edible decorative or structural elements.
Wildflower Bakes does not use wire decorations inside cakes as part of its standard decoration policy.
13. Allergens and Dietary Requirements
Wildflower Bakes handles ingredients containing the 14 regulated allergens in its kitchen.
Allergen information will be provided in accordance with applicable food safety and allergen information requirements.
Customers must inform Wildflower Bakes of any allergy, intolerance or dietary requirement before an order is accepted.
Wildflower Bakes may be able to accommodate some dietary requirements or ingredient exclusions, subject to discussion and availability.
Because products are prepared in a kitchen where multiple allergens are handled, Wildflower Bakes cannot guarantee an allergen-free environment.
Customers with severe allergies or medically significant food allergies should consider this risk carefully before placing an order.
A product will not be described as “free from” a particular allergen unless Wildflower Bakes is able to make that claim responsibly and in accordance with applicable food law and allergen guidance.
Customers should not rely solely on a general dietary description and should contact Wildflower Bakes before ordering if they have any concerns about allergens.
14. Intellectual Property
All intellectual property created by or for Wildflower Bakes, including the Wildflower Bakes name, logo, branding, website content, original photographs, social media content, written materials and other original creative work, remains the property of Wildflower Bakes unless otherwise stated.
Customers may not copy, reproduce, modify, distribute or use Wildflower Bakes’ intellectual property for commercial purposes without prior written permission.
Where a customer supplies artwork, designs or other creative materials, the customer remains responsible for ensuring that they have permission to use those materials.
15. Photography and Marketing
Wildflower Bakes may take photographs of completed products for its own records, portfolio, website and social media marketing.
Where a photograph includes identifiable personal information, children or private event details, Wildflower Bakes will take reasonable steps to respect the customer’s privacy.
Customers may contact Wildflower Bakes if they have a specific concern about a photograph being used for promotional purposes.
Any personal information will be handled in accordance with the Wildflower Bakes Privacy Policy.
16. Confidentiality and Privacy
Wildflower Bakes will take reasonable steps to keep private information provided by customers confidential.
Customer information will be used for purposes connected with discussing, preparing, fulfilling and administering an order and in accordance with the Wildflower Bakes Privacy Policy.
Information may be disclosed where:
the customer has given permission;
disclosure is necessary to fulfil the order;
disclosure is required by law; or
the information is already publicly available.
The Wildflower Bakes Privacy Policy explains how personal information is collected, used, stored and protected.
17. Service Modifications
Wildflower Bakes may modify, discontinue or change the availability of products, flavours, designs, services or prices from time to time.
Where an order has already been accepted, Wildflower Bakes will not make a material change to the agreed order without discussing the change with the customer wherever reasonably possible.
Where a change is necessary because of circumstances beyond Wildflower Bakes’ reasonable control, Wildflower Bakes will work with the customer to find a reasonable alternative where possible.
Customer-requested changes may be subject to availability and additional charges.
18. Refunds
Refunds will be considered in accordance with these Terms & Conditions and the circumstances of the order.
Where Wildflower Bakes is unable to provide products that have been paid for, any refund due will be processed using the original payment method where reasonably possible.
Refunds will not normally be available for products that have been consumed, disposed of or damaged after collection, unless the customer has a legal right to a refund or other remedy.
Nothing in these Terms & Conditions removes or limits any statutory rights that cannot legally be excluded.
19. Complaints and Quality Concerns
If you are unhappy with an order, please contact Wildflower Bakes as soon as possible and provide details of the concern.
Where appropriate, photographs should be provided to help us understand and investigate the issue.
For a complaint relating to the quality or condition of a cake or other product, Wildflower Bakes may request that the remaining product is retained and made available for inspection.
Customers should not dispose of the product before contacting Wildflower Bakes if they wish to make a quality complaint.
Where a complaint is made about a food safety issue or suspected allergic reaction, Wildflower Bakes should be contacted immediately.
Complaints will be considered fairly and in accordance with the customer’s legal rights.
20. Resolving Disputes
If a customer has a complaint or concern, both parties should first try to resolve the matter through good-faith communication.
Wildflower Bakes will make reasonable efforts to investigate and respond to complaints.
If a dispute cannot be resolved informally, either party may pursue any legal remedies available to them.
Nothing in these Terms & Conditions prevents a customer from exercising any legal rights available to them.
21. Limitation of Liability
Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, liability for faulty or misdescribed goods, or any other liability that cannot legally be excluded or limited.
Subject to the above, Wildflower Bakes will not be responsible for loss or damage caused by circumstances outside its reasonable control.
Wildflower Bakes will not be responsible for damage caused after collection by incorrect transport, handling, storage or use of the product.
Nothing in these Terms & Conditions affects the customer’s statutory rights.
22. Right to Terminate
The customer may request to cancel or postpone an order by contacting Wildflower Bakes as soon as possible.
The consequences of cancellation or postponement will be dealt with under Section 8 of these Terms & Conditions.
Wildflower Bakes may cancel an order where:
payment remains outstanding;
the customer has provided materially incorrect or incomplete information;
the customer requests changes that cannot reasonably be accommodated;
the customer behaves in an abusive, threatening or inappropriate manner; or
Wildflower Bakes is unable to safely or reasonably fulfil the order.
Where Wildflower Bakes cancels an order, any refund due will be dealt with in accordance with these Terms & Conditions.
Cancellation will not affect any rights or obligations that arose before cancellation.
23. Changes to These Terms & Conditions
Wildflower Bakes may update these Terms & Conditions from time to time.
The Terms & Conditions applying to an order will be those in force and provided to the customer when the order is accepted, unless a change is required by law or agreed with the customer.
24. Governing Law
These Terms & Conditions are governed by the law of England and Wales.
Any dispute will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory rights the customer may have under applicable law.
25. Statutory Rights
Nothing in these Terms & Conditions affects the customer’s statutory rights.
If any part of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
